Terms of Sale and Delivery

  1. Orders and Payment
    • All orders are subject to acceptance by DIGITAL BAY. We reserve the right to refuse
    or cancel any order for any reason, including but not limited to product availability,
    errors in pricing or product information, or suspected fraud.
    • Full payment is required before shipment. We accept the following payment methods:
    Credit Card, Debit Card, PayPal, Bank Transfer.
    • Once payment is confirmed, your order will be processed.
  2. Delivery (Shipping Policy)
    • Lead Time: Our standard lead time is three (3) business days (excluding weekends
    and public holidays) after payment confirmation. If there is a delay, we will notify you
    via email with an updated estimated delivery date.
    • Delivery Method: We use DAP (Delivered at Place) Incoterms. This means we are
    responsible for delivering the goods to the named place of destination, but you are
    responsible for import clearance and any applicable duties, taxes, or other fees.
    • We use reputable shipping carriers such as Flat Mail, DHL, FedEx, UPS. Tracking
    information will be provided via email with tracking number and link once your order
    has shipped.
    • Shipping Costs: Shipping costs are calculated based on weight, destination and will
    be displayed at checkout.
    • Delivery and Acceptance: Upon delivery, please inspect the package for any damage.
    If there is visible damage, refuse delivery and contact us immediately. After accepting
    the delivery, please verify the quantity and model of the Products against your order.
    Any discrepancies must be reported within 24 hours of receipt.
    • Delayed Delivery: If delivery is delayed due to our or our carrier’s fault, we will make
    reasonable efforts to communicate with you and provide a solution.
    • Non-Receipt of Goods: If you have not received your order by the estimated delivery
    date, please contact us for assistance.
  3. Customs and Duties
    As per DAP Incoterms, you are responsible for all import duties, taxes, and customs
    clearance fees in your country.
  4. Limitation of Liability
    To the maximum extent permitted by law, DIGITAL BAY shall not be liable for any
    indirect, incidental, special, consequential, or punitive damages, or any loss of profits
    or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill,
    or other intangible losses, resulting from (a) your use or inability to use the Products;
    any unauthorized access to or use of our servers and/or any personal information
    stored therein; •(c) any interruption or cessation of transmission to or from our
    services;
    •(d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through
    our services by any third party; •(e) any errors or omissions in any content; or (f) any
    loss or damage of any kind incurred as a result of your use of any content posted,
    emailed, transmitted, or otherwise made available via the services, whether based on
    warranty, contract, tort (including negligence), or any other legal theory, whether or
    not we have been informed of the possibility of such damage.
  5. Governing Law
    • These Terms shall be governed by and construed in accordance with the laws of Hong
    Kong.
